What is an IEP?

Parents and school districts enter into contracts called Individualized Education Plans to ensure children will receive all the services they need to receive a fair and appropriate public education. The goal: to bring parents, administrators, therapists, teachers, and other staff together to help determine the best course of action for the student.

How often do I have to attend an IEP meeting?

IEP’s are typically held annually, with a lengthier, more comprehensive IEP every three years. Ff you feel that your child has been denied a fair and appropriate public education, you can also request an IEP.

What happens if I missed my IEP meeting?

If you fail to attend your child’s IEP meeting, the district will continue without you! Decisions on your child’s education will be made, and it may be difficult to modify those decisions after the fact.

Who can attend an IEP?

It is encouraged that you bring an attorney, or at the very least, an advocate specializing in IEP matters.

Many parents bring family members or friends to their IEP hearing. In these situations, the companion might not have any formal training in administrative or education law. If that is the case, the family member or friend can sometimes complicate an already tense, emotional situation even more charged.

The goal is to come to an amicable solution, and often, the process is done with attorneys representing the interests of both sides.

What is a Due Process Hearing for an IEP?

A Due Process Hearing is a formal proceeding held by the Office of Administrative Hearings (OAH). Many school districts bring on law firms to represent them against parents. They’re held under tight deadlines with almost no margin of error, particularly when dealing with the admissibility of evidence. It is critical to be knowledgeable of all the laws, because losing at a Due Process hearing means that the case will have to be appealed to state court.
